    Tarion Warranty

    Warranties

    Buying a new home is an exciting time and with it comes responsibilities and important protections. 

    In Ontario, Tarion Warranty Corporation administers the Ontario New Home Warranties Plan Act which provides warranty protection for new homes in Ontario. This warranty program protects homeowners against construction defects, and ensures builders meet all obligations. Having a thorough understanding of your Tarion warranty helps you know what’s covered, how to make claims, and what to look out for during your first seven years of homeownership.

    What Is a Tarion Warranty?

    Tarion, established by the Ontario provincial government, administers the Ontario New Home Warranties Plan Act. When you purchase a new Tamarack Home, you’re automatically covered under this plan. This provides statutory protection against construction defects, material deficiencies, and other issues that may arise in the early years of ownership. Your warranty is divided into three coverage periods:

    One-Year Warranty

    Coverage begins on the possession date and lasts until the first anniversary of possession. This warranty covers:

    • Defects in workmanship and materials
    • Defects that cause the building to be unfit for habitation
    • Ontario Building Code violations
    • Major structural defects
    • Unauthorized substitutions
    Two-Year Warranty

    Coverage begins on the possession date and lasts until the second anniversary of possession. This warranty covers:

    • Water penetration through the basement or foundation walls

    • Defects in materials or work (including windows, doors and caulking) that result in water penetration into the building envelope

    • Defects in materials and work in distribution systems.
    • Defects in materials and work which result in detachment, displacement or deterioration of exterior cladding (such as brickwork, aluminum or vinyl siding)

    • Violations of Ontario Building Code regulations under which the Building Permit was issued, affecting health and safety, including, but not limited to, fire safety, insulation, air and vapour barriers, ventilation, heating and structural adequacy.
    Seven-Year Warranty

    The Major Structural Defect (MSD) warranty covers years 3-7 and includes significant damage due to soil movement, major cracks in basement walls, collapse or serious distortion of joints or roof structure and chemical failure of materials.

    In addition to general exclusions such as damage/defect due to condominium corporation action, normal wear and tear, third-party damage, secondary/consequential damage or supplementary warranties/agreements, the MSD warranty specifically excludes: dampness not arising from failure of a load-bearing portion of the building; damage to drains or services; and damage to finishes.

    Maintenance
    • Ensure you regularly maintain your home, especially the HVAC, plumbing, and electrical systems.
    • Tarion coverage does not extend to any damages caused by homeowner modifications or neglect.

    How To Make A Claim

    1. Before making a claim, notify your builder of any issues and give them the opportunity to review and address it.
    2. If the builder fails to adequately resolve your issue, or does not feel that the item is warranted, you can submit a formal warranty claim to Tarion. To be eligible for Tarion’s assistance you must ensure you report your claim within the relevant warranty time frames.
    3. Once you submit a claim to Tarion, it triggers a 120 day initial repair period during which your builder should repair or resolve any items that are covered by your warranty. This 120 day timeframe does not apply to any major structural defects.
    4. If your builder has not adequately resolved a warranted item you may request a conciliation from Tario to inspect the item. Conciliation is a process where Tarion assesses the items on a homeowner’s warranty form and decides whether they are covered under the warranty set out in the Ontario New Home Warranties Plan Act.
    5. If the conciliation contains items that are in fact covered by your warranty, your builder will have a final 30 day period to resolve them with you. Tarion will contact you 30 days after the conciliation to confirm all the items have been resolved to your satisfaction.
